Delhi High Court ne Vimal Elaichi ki maker company P.B. Agro LLP ki petition reject kar di hai.

Company ne Maharashtra FDA dwara brand ambassadors Shah Rukh Khan, Ajay Devgn aur Tiger Shroff ko issue kiye gaye show-cause notices cancel karne ki maang ki thi.

Maharashtra FDA ne advertisement mein product ko allegedly galat tareeke se present karne ko lekar yeh notices issue kiye the.

Petitioner P.B. Agro LLP ke mutabik, Vimal Elaichi tobacco product nahi hai. Company ne ise “pan masala not containing tobacco”, yani bina tobacco wala pan masala bataya hai. Available report mein alleged misrepresentation exactly kis baat ko lekar thi, iski detailed information nahi di gayi hai.

Company ne Delhi High Court mein argument diya tha ki woh Delhi se operate karti hai, advertisement campaign Delhi se manage hua aur brand ambassadors ko payment bhi Delhi se ki gayi.

Justice Swarana Kanta Sharma ne kaha ki regulatory action Mumbai se shuru hua aur notices Maharashtra FDA ne issue kiye. Isliye Delhi High Court ke paas is mamle ki territorial jurisdiction nahi hai.

Court ne allegations ke merits par koi faisla nahi diya hai. Show-cause notices cancel nahi hue aur company ya kisi actor ko guilty bhi declare nahi kiya gaya. Petition sirf territorial jurisdiction ke ground par reject hui hai.
